Terms and conditions of booking

We have tried to keep our Terms and Conditions of Booking as simple as possible, we realise nobody likes the small print!

DEFINITIONS

“NFT” means the company, Newquay Fishing Trips
“Customer” means the person, company or organisation booking a trip.
“Fee” means the cost of the trip as published on the NFT website or otherwise agreed with the skipper.

1. BOOKING

1.1  A booking will be provisional until NFT receives a Deposit or full Payment as defined in Section 2 below
1.2  Upon receipt of the above NFT will confirm the booking with the customer and you will be informed with all the information required including departure points, directions and postcodes of nearest carparks.
1.3  These Terms and Conditions of Booking apply to all bookings confirmed to a Customer by NFT and by entering into a confirmed booking the Customer agrees to be bound by them.
1.4  A copy of these Terms and Conditions of Booking is available on the NFT Company Website or by email on request.

2. DEPOSIT OR PAYMENT

2.1  A deposit by prior arrangement with the skipper of the total fee may be required for booking the whole boat via a payment link that will be sent to the customer. The remainder of the Fee is payable on the day.
2.2  On the day we can only accept cash as payment for the remainder of the Fee, no cheques or credit cards.
2.3 When booking via our website the full amount is payable (on all trips) at the time of booking using our online booking system.

2.4 When using the boats equipment you accept full liability for all loses/breakages to be paid for in full before departure Reels £80 per unit and Rods £50 per unit

3. GIFT VOUCHERS

3.1 Gift Vouchers are valid for 12 months from the date of purchase and CANNOT be refunded, be aware NFT does not always trade through the winter season therefore vouchers can only be redeemed whilst NFT is actively trading.
3.2 There is no cash alternative if the recipient chooses a trip to a lower cost than the Voucher value, or does not redeem their Voucher.
3.3 The Voucher can be redeemed against a more expensive trip, the difference to be paid on the day.
3.4 Our trips get booked up quickly on a first come first served basis, especially in summer. Therefore it is best for the recipient to get a date booked in promptly upon receipt of their Voucher.
3.5 All trips are weather and demand dependant and if the sea is too rough or we don’t have sufficient bookings to run the trip (4+ persons) it will be postponed. In this event the recipient can simply choose another available date.

4. CANCELLATION OR REDUCTION OF PERSONS BY CUSTOMER

4.1  More than 4 weeks before the booked date then the Deposit or Payment is refunded.
4.2  Less than 4 weeks before the booked date then the Deposit or Payment is forfeited.
4.3  Less than 2 weeks before the booked date then the full Fee is payable, this includes a reduction in persons on small group bookings.
4.4  If the Customer requests an early return to harbour then the full Fee is payable
4.5  The vessel WILL NOT return to port on individual trips for seasickness unless agreed by all parties on board.
4.6 The Customer may change the date of their trip with a minimum of 2 weeks notice.
4.7 If NFT books a second boat to accommodate your party you will be liable for full payment of both boats in the event you only require one boat due to lack of numbers attending.
4.8 Late arrivals will not be entitled to rebook or a refund, you must be at the designated departure point no later than 20 minutes before the departure time of the trip.
Sometimes due to tides, weather or port restrictions the charter may sail slightly earlier or later than planned and therefore it is the customers responsibility to leave enough spare time to park and ensure they are at the designated departure point 20 mins before departure, the boat will not wait for the customer if you are late the boat will sail and you will not be refunded.

5. CANCELLATION BY NFT

5.1  Due to bad weather on the morning of the trip, the Customer has the option of the Deposit or Payment being refunded or moved to another available date.
5.2  Due to illness, mechanical breakdown or other unforeseen circumstances, the Customer has the option of the Deposit or Payment being refunded or moved to another available date.
5.3  NFT  cannot be held liable for any consequential loss incurred by the Customer if NFT has to cancel the trip.
5.4 NFT will await instruction from the Customer to reschedule or refund the Deposit or Payment if the trip cancelled by NFT.
5.5  Please allow up to 28 days for the refund of your Deposit or Payment to be processed, especially during busy times when the boat is mostly at sea.

6. WEATHER AND CONDITIONS

6.1 You will receive a courtesy text message from NFT the day before the trip to confirm weather and finalise departure details, Failure to reply will be taken as acceptance by the Customer of any decisions made by NFT for the following day.
6.2  Phone signal at sea and certain areas on land in Newquay can be intermittent therefore if the customer does not receive a text message it is the customers responsibility to contact NFT by 2100hrs the day before the trip to confirm weather and finalise details. Failure to do so will be taken as acceptance on decisions as stated in 6.1 above.
6.3 NFT decision is final with regard to the weather but we try to get out if possible with due regard to safety and common sense.
6.4 NFT reserves the right to alter the planned trips and timings with regards to weather, fishing and embarkation/disembarkation conditions, for example a wreck fishing trip may have to become an inshore Reef trip in the event of strong onshore winds or algae bloom. Stag, Hen and Boat Trips or Ash Scatterings may continue within the shelter of Newquay Bay. The Skippers decision is final in these matters

7. ALCOHOL, DRUGS AND BEHAVIOUR

7.1  Due to changes in insurance company requirement only a small quantity of low strength alcohol will be allowed on board and always at the discretion of the Skipper.
7.2  The use of illegal Drugs is strictly prohibited. Drug abuse or excessive alcohol consumption will cause an immediate return to port and NFT may alert the relevant authorities if deemed necessary.
7.3  Any injury or loss sustained on board must immediately be reported to the Skipper.
7.4  Infants and dogs will only be taken with prior agreement of the Skipper.
7.5  NFT Vessel, ATLANTIS is licensed for a maximum of twelve passengers and one crew.
7.6  Any medical conditions that might affect a customer during the trip MUST be reported to the Skipper before departure.
7.7 Unruly or abusive  behaviour will not be tolerated on any of our charters, if any of our staff deem a customers  behaviour unsuitable or offensive at any point whilst on board NFT has the right to terminate the charter and return to port with no refund given

8. DEPARTURE INFORMATION

8.1 Due to Newquay being a tidal port we have three departure points to embark and disembark depending on the state of the tide, your will receive an notification of which depart point you are to muster at
8.2 The boat will not wait for late arrivals, if you miss the boat you are not entitled to rebook or a refund. You must arrive at your departure point (as stated in the rest of section 8 below) no later than 20 minutes before your designated departure time.
8.3If your charter departs from SOUTH QUAY NEWQUAY HARBOUR TR71HR
There is a pay and display car park at the harbour itself but had very limited spaces so you may need to leave extra time to find  alternative parking in the town.
Once at the harbour please walk out to the end of the quay to where the white sign reads ‘all boat trips down the steps’ where you will be met by matt with the boat at the designated time.
The boat is red/white with a red canopy called Atlantis.

Please muster at this departure point 20 minutes before the trip start time and the boat will come alongside to collect you.
8.4 If your charter departs NORTH QUAY NEWQUAY HARBOUR The closest car park is the Belmont car park TR71HG
It’s then a short walk down the hill past the red lion pub.
When you pass the harbour hotel at the bottom of the hill take a RIGHT at the fork in the road which will lead you further down the hill and onto the north quay
The red/white boat Atlantis will be there to meet you at your designated time slot.

8.5 If your charter departs from the FLY CELLARS This is a loading platform we use located out side of the harbour at low tide.
The closest car park is the Belmont car park TR71HG
Then it’s a short walk down the hill past the red lion pub.When you pass the harbour hotel at the bottom of the hill take a hard left at the fork in the road which will lead you along a path and down onto the big concrete platform called the fly cellars. There is a map on the contacts page of my website and the route to fly cellars is shown in yellow for a visual reference
The red/white boat Atlantis will be there to meet you at your designated time slot.

8.6 Newquay is a historical Cornish port comprising of steep uneven stone steps on all of our departure points  All of your group must be able bodied in order to safely embark and disembark.

9.INSURANCE AND LEGAL

9.1  Anything you catch you can keep if above the legal minimum landing size and not subject to a landing ban. In the interests of conservation at NFT we practise the return of all Conger Eels, Shark and most Rays.
9.2  It is illegal to sell any fish caught on board.
9.3  NFT Vessel and Skipper are licensed to operate as required by the MCA – Maritime and Coastguard Agency.
9.4  NFT maintains £2 million Public Liability Insurance.
9.5  These Terms and Conditions of Booking and all other express and implied terms of the contract shall be governed and construed in accordance with the laws of England and the parties agree to submit to the jurisdiction of the courts of England and Wales.
9.6  Nothing in these Terms and Conditions of Booking shall affect the rights of Consumers.
9.7  All clauses and sub-clauses of this Agreement are severable and if any clause or identifiable part thereof is held to be unenforceable by any court of competent jurisdiction then such enforceability shall not affect the enforceability of the remaining provisions or identifiable parts thereof in these Terms and Conditions of Booking.
